Photoshoot Terms and conditions

1. Booking and Reservation:

1.1. To secure a booking, a non-refundable retainer fee £49 is required. This fee reserves the photographer's services and the agreed-upon date and time.

2. Cancellation and Rescheduling:

2.1. If the client needs to cancel or reschedule the session, they must notify the photographer at least 2 days before the scheduled date. Failure to do so may result in the loss of the retainer fee. 2.2. In case of adverse weather or unforeseen circumstances that prevent the photoshoot, both parties will work together to reschedule the session.

3. Pricing and Packages:

3.1. The client agrees to pay the agreed-upon package price as specified in the invoice.

3.2. Additional products or services not included in the initial package will be charged separately.

4. Image Delivery:

4.1. The photographer will provide the client with a selection of edited images from the session. The number of images included will be as specified in the chosen package.

4.2. The photographer retains the copyright to all images and reserves the right to use them for marketing and promotional purposes unless otherwise agreed upon in writing.

4.3 It is illegal to attempt to download/screenshot or to attempt to remove a watermark from, any image taken and posted online by CMP for any reason. Should an image online be saved via any means, and used elsewhere without the written permission of CMP, whether the copyright has been removed or not, a copyright infringement fee of £500 per image will be applied to avoid court action, and must be paid within 28 days.a)

4.4 CMP edits all image lighting and colours before presenting to Client. Additional edits are carried out such as background and skin editing at the discretion of CMP, and CMP reserves the right to charge the Client for additional editing such as face swaps and body shape to cover time involved, at a rate of £10 per image. Any additional edit requests MUST be raised by Client at the proofing stage. Requests not raised at proofing stage will not be considered once products have been ordered.

c) lf the Client does not view or purchase images within three months of the session without arrangement, CMP will assume they are not wanted and will delete all files.

d) If you have any complaint about the images, this must be raised at the proofing stage.

5. Editing and Processing:

The photographer will apply professional editing techniques to the selected images. Any further editing or retouching requests may incur an additional fee.

7. Turnaround Time:

The photographer will provide the preview gallery within 3-5 days. Final orders will be fully edited within 3 weeks from the date of payment, unless otherwise stated.

8. Client Cooperation:

The client agrees to arrive on time for the session and cooperate with the photographer's directions during the shoot. The photographer is not responsible for the behavior of any children or individuals involved in the session.

9. Liability:

The photographer is not liable for any injuries, accidents, or damages that occur during the photoshoot.

10. Payment and Late Fees:

Late payment fees may apply if the client fails to pay the remaining balance by the specified due date.

11. Client Satisfaction:

The client understands that photography is a creative art form, and the photographer's style may vary. The photographer will strive to meet the client's expectations but cannot guarantee specific results due to the nature of newborn photography and the babies co-operation.

12. Image Privacy and Mobile Phones:

To maintain the privacy and exclusivity of the photoshoot, clients and their guests are prohibited from taking photos or videos using mobile phones or any other devices within the studio premises during the session. Copyright Protection: as the photographer Cara retains the copyright to the images created during the photoshoot. This means that she has exclusive rights to reproduce, distribute, and display those images. If clients or their guests take photos with their own devices, it can potentially lead to the dissemination of unedited or unapproved images, which could harm your professional reputation and potentially infringe on your copyright.

13. Force Majeure and fulfilment of obligations

13.2 CMP shall not be liable to the Client for any failure, in whole or in part, to fulfil its obligations where failure arises as a result of an event or circumstances beyond its control, which may include (but are not limited to) equipment failure, inclement weather, illness or injury.

13.1 Due to health and safety concerns, if you, your baby or family members attending the photo session are unwell, you will need to cancel your photo session and book another convenient date/time slot. You will not have to pay another deposit. 

13.3 The Client understands and accepts that the photographic coverage will be as CMP's professional expertise determines. Special requests are not binding instructions although every effort is made to comply with the Client’s wishes. 

13.4 In the unlikely event of total photographic failure or cancellation of the contract by either party or in any other circumstances the liability of one party to the other shall be limited to the total value of the session. Neither party shall be liable for indirect or consequential losses.

13.5. If a client fails to read the supplied Photo Session Preparation Guide, and therefore fails to carry out required preparations prior to a newborn session, CMP will not be held responsible for any resulting reductions in quality or quantity of images supplied.

14. Image Retention:

The photographer will retain the edited images for a period of 3 months after the session date. If images are not purchased within this time the photographer cannot guarantee images will be available. If the client has not purchased the images within this timeframe, the photographer reserves the right to delete the images permanently.

15. Photographic Prints

a) All images produced by CMP are done on a calibrated monitor, and all prints will be a true reflection of the editing carried out by CMP. We will not be held responsible for variances in images as a result of clients viewing images on non calibrated screens or monitors. CMP will not be responsible for any colour variation on prints made outside of CMP.

b) All prices are subject to change without notice by CMP. No consideration will be given to previous clients regarding product pricing, availability, package structure, or session fees. 

C) Any physical prints ordered by CMP are presumed to have been received in good condition unless the Client notifies CMP in writing of any discrepancy or error within 5 days of receipt. 

By booking a session with Cara Mia Photography, the client acknowledges that they have read and agreed to these terms and conditions.
